USCIS is finalizing new fee schedules for the EB-5 Immigrant Investor Program, set to take effect November 30, 2026, following a program-specific fee study mandated by the EB-5 Reform and Integrity Act of 2022. The updated fees are designed to fully recover the cost of administering the program, meet statutory processing time goals, and fund enhanced integrity measures including audits, site visits, and fraud prevention. Staffing and immigration attorneys advising foreign national investors or regional centers should factor the new fee structure into client cost projections ahead of the November deadline.
