Maryland's Labor and Employment Code Section 3-717, effective October 1, 2020, prohibits employers from using facial recognition services to create facial templates during applicant interviews without a signed written consent waiver. The law is narrower than Illinois's AI Video Interview Act but intersects with broader biometric data regulations including BIPA, CCPA, and Maryland's own PIPA. Multi-state employers and staffing agencies conducting video or AI-assisted interviews must account for this patchwork of state-level compliance requirements.
