EEOC Sues Texas Staffing Firm Sibitalent for H-1B-Only Hiring Bias
HR Dive · United States · Oct 6, 2026
The EEOC filed a national origin discrimination lawsuit on Sept. 30 against Texas-based technology staffing firm Sibitalent Corp., alleging it explicitly restricted a data analyst role to H-1B visa holders and referred only candidates from India and Nepal. A recruiter's email to a California job seeker included the phrase "ONLY H1B," and when the applicant questioned the legality, the recruiter confirmed the restriction before cutting off communication. The case is part of EEOC Chair Andrea Lucas's broader campaign against anti-American bias, which includes active solicitation of charges from workers who believe they were displaced in favor of visa holders. Staffing firms that filter candidates by visa status risk EEOC enforcement action under Title VII, making this a direct compliance warning for the industry.
