EEOC Sues IT Staffing Firm Sibitalent for H-1B-Only Job Posting

The EEOC has filed suit against Sibitalent Corp., a Texas-based IT staffing firm, alleging it refused to refer a qualified American applicant for a Mountain View data analyst role because he lacked an H-1B visa. A Sibitalent recruiter allegedly marked the posting 'ONLY H-1B,' then cut off communication after the applicant questioned the legality of the requirement, and instead referred two foreign nationals for the position. The lawsuit charges national-origin discrimination under Title VII and arrives as EEOC Chair Andrea Lucas has made enforcement against visa-based exclusion of American workers a stated 2025 priority.
