DHS Ends EAD Auto-Extensions for Renewals Filed After Oct. 30, 2025
NewsData.io · United States · Oct 27, 2026
The Department of Homeland Security finalized a rule on October 14, 2026 that eliminates automatic extensions of Employment Authorization Documents (EADs) for renewal applications filed on or after October 30, 2025. Under the prior system, eligible workers could continue working while USCIS processed their renewal; the new rule means employees may face a gap in work authorization if their EAD expires before the renewal is approved. The change does not affect TPS-related extensions, L-2 spouse status-based authorization, or renewals filed before the October 30, 2025 cutoff. Staffing firms and employers with foreign national workers on EADs must now monitor expiration dates closely and may need to pause assignments if renewals are not approved in time.
